Terms of use
1. General Terms and Conditions
These terms and conditions (hereinafter the “Terms and Conditions'') apply to the use of the eisaa.org online service (hereinafter the “Service”) maintained by Ethiopian Information System Audit Association (EISAA (hereinafter the “Service Providers''). The Terms apply to the relationship between the Service Providers and the Service User (the “User”), regardless of the terminal device on which the User uses the Service).
The purpose of the service is to create a communication platform for Information System Auditors and digital technology professionals to facilitate exchange of expertise and best practices. In addition it is believed that the platform provides the opportunity to establish relationships among its members and facilitate the exchange of expertise and experience of the Information System Auditors. Every member can participate as volunteering offers opportunities for participation and inclusion.
A possible relationship about volunteering always arises directly between the volunteer and the association.
The Service Provider maintains a database of users of the Service. The database provides information on the number of users of the service, their age and gender, and the interest in the themes of the member volunteer role.
The Service Provider strives to provide the highest possible standard of the Service, but does not warrant the correctness, accuracy or availability of the Service or any portion thereof.
The Service is made available to the User as it is at any given time. The providers of the Service have the right to add, change and remove parts of the Service or to change the Service or the Service or to terminate the Service in whole or in part. The providers of the Service have the right to terminate the provision of the Service to the User for a justified reason.
2. Programs and telecommunications connections
Use of the service requires a browser and other software and equipment necessary to establish a communication connection, the costs of which are borne by the User.
The Service Providers endeavor to make the Service available to up-to-date versions of the most common browsers, but the Service Providers do not warrant that the Service will work with any single browser or browser version or that the Service will be compatible with any browser add-on.
The Service Providers shall not be liable for any errors or damages caused by the operation of the software or hardware used by the User to use the Service, and under no circumstances shall the Service Providers be liable for any damages (including various security risks such as viruses and theft).
3. Registration
Registration for members / volunteer assignments in the service requires registration.
The service has public sections that can be used without registration, such as being members and volunteering. These conditions also apply, as a part of the use of such public sections.
Registered users must comply with the following regulations:
The user may not provide false personal information to the Service or create a user account for persons other than himself.
A user is not allowed to create multiple personal user accounts.
The service may only be used by persons at least 18 years of age whose legal capacity is not restricted and comply with the association regulation membership requirements specially article 6.
The user's contact information must be correct and up-to-date.
The Service Providers have the right to delete, change or take over the User's chosen username if the Service Providers deem it inappropriate (for example, in a situation where the trademark owner complains about a username that is not closely related to the user's real name).
4. Rights
The content of the service is protected in accordance with the Copyright Act and international agreements protecting copyright and related rights.
The providers of the Service reserve all rights to the content of the Service.
The rights to the computer programs used to provide the Service are owned by the licensees of the computer programs.
The providers of the Service grant you the right to use the Service in accordance with these terms and the policies set out in these terms.
The User is not entitled to use the Service for commercial purposes such as advertising.
All information and content entered by the User into the Service is the property of the User or any other party who owns the rights to the material. When a user enters information or other content into the Service:
You grant the Service Providers the following express rights to copyright-protected content, such as written texts, images, and videos (the "Copyright Content"): non-exclusive, transferable, sublicensable, royalty-free, worldwide license (the "Copyright License") to use any content published on the Service copyright content.
The User grants the providers of the Service the right to modify, copy, publish or not to publish the copyrighted content or other material entered by the User into the Service.
Removes from the Service any content entered by the User that is alleged to infringe any copyright, other intellectual property or other third party right, or that the Service Provider otherwise deems inappropriate or inconsistent with the purpose of the Service.
The User grants the Service Providers the right to utilize the feedback and development suggestions related to the Service without any obligation to compensate the User for such use.
5. Responsibility for usernames
The user is responsible for the confidentiality of the username and password and undertakes not to disclose them to any third party.
The user must immediately notify the loss or suspected disclosure of the username or password to a third party by e-mail to eisaa.org@gmail.com
The User is responsible for the use of his / her user IDs, including all costs and damages caused by their use until the User has made the above-mentioned notification to the Service Provider and the Service Provider has acknowledged receipt of the User's notification.
6. Responsibility for Content
Content produced by service providers
The providers of the service are responsible for the content, copyright and other intellectual property rights of the material they produce.
The providers of the Service are not responsible for the other content of the Service or for any other content delivered or received through the Service or otherwise utilizing the Service.
User Generated Content
The providers of the Service are not responsible for the material entered by the User into the Service or for the services of other service providers or their content, copyrights or other intellectual property rights, even if these materials are accessed through a link included in the Service or otherwise using the Service.
The User of the Service is responsible for the content of the material entered into the Service or otherwise distributed to other network users using the Service and that the use of such material in connection with the Service does not infringe any third party copyright, industrial or other protected rights or cause harm or disruption network, the Service Provider, the Service or third parties. The User is responsible for ensuring that the User has the right to transfer to the Service Provider the rights under Section 4 to the material entered into the Service.
If the User enters image or video material into the Service, the User must ensure in particular that the User has all necessary rights to such material, including copyright and the right to modify, retransmit and publish the material. In general, this requires that the User has photographed the material himself or herself and that he or she has permission to publish any natural person appearing in the material, in the case of minors, from their guardian.
The User undertakes to compensate the Service Providers for any damages that may be caused to the Service Providers as a result of the material used by the User in connection with the Service not complying with these Terms.
Suspected infringement of intellectual property rights
If the User discovers material in the Service that may infringe the copyright or other intellectual property rights of the User or a third party, the User is requested to notify the following service without delay using the customer eisaa.org@gmail.com.
7. Use of personal information
The Service Providers process the User's personal data in accordance with the Service's [Privacy Policy] and [Privacy Statement] and privacy laws.
8. Use of cookies and other technologies
The Service uses cookies and other technologies that follow the use of the Service in the manner described in more detail in the [data protection clause]. The main purpose of the use of cookies and other similar technologies is to develop the Service, improve the User's experience of using the Service and statistics on the use of the Service.
By accepting these terms, the User consents to the use of cookies and other similar technologies following the use of the Service for the purposes described above.
9. Downtime
The Service Providers strive to make the Service available 24 hours a day, 7 days a week, but the Service Providers do not guarantee that the Service will always be available.
There will be service outages that may be caused by a planned or unplanned need for maintenance, overload, or other reasons such as a network attack. The service providers strive to inform the User about long-term outages.
If the individual downtime of the Service related to the Service for a fee-based time-based service, where the payment made by the User grants the User a certain temporary use of the Service exceeds 24 hours, or if the total monthly outages of such service exceed 96 hours, the Service Providers extend The providers of the Service have no other or wider liability for interruptions in the use of the Service.
10. Restrictions on Use of the Service
The User of the Service may not:
publish unauthorized commercial communications (such as spam);
collect user information or content or otherwise use the Service through automated tools (such as collection bots, robots, search agents or collectors);
engage in network marketing, such as pyramid marketing;
download viruses or other malicious software;
trying to obtain other users' credentials or use another person's account;
harass, threaten or harass other users;
post content that is hate speech or threatening in nature, pornographic or otherwise contrary to good manners or rude to other users, or that incites violence or hatred, or that contains nudity or violence;
use the Service for any illegal, misleading, hostile or discriminatory activity;
engages in any activity that may obstruct, overburden or impair the operation or appearance of the Service, such as denial of service attacks or interference with the execution of the Site or other functions of the Service;
promote or encourage action in violation of these Terms;
modify, create derivative works from, or otherwise attempt to decompile the source code of the Service.
11. Changes to Terms and Conditions
The providers of the Service have the right to change these terms of use, the policies related to the Service and the basis and amounts of the fees charged for the use of the Service.
Minor changes to the terms, policies and fees will be notified to the User on the Service.
Significant changes to the terms, policies and fees will be notified to the User in the Service and by e-mail, in addition to which the User will have the opportunity to read the changed terms, policies and payments on the Service before continuing to use the Service. Continued use of the Service after notice of change is deemed to be acceptance of the changed terms, policies and fees.
12. Disassembly
The Service Providers have the right to terminate the provision of the Service or any part thereof to the User if the User violates these Terms or their spirit or poses a risk of legal sanctions against the Service Providers or other users.
The Service Providers will notify you of the termination of the Service by email or on the Service the next time the User attempts to access their user account. The User may delete the User Account or terminate the Service at any time.
Any payments made by the User for the Service will not be refunded.
13. Disputes
This Agreement is governed by the laws of Ethiopia, without regard to its conflict of laws rules.
All disputes based on this agreement shall be settled at first instance in the Addis Ababa District Court.
If a party makes a claim against the Service Providers based on User Content posted on the Service or any other activity you use on the Service, the User agrees to indemnify the Service Providers for all damages, losses and costs (including reasonable legal fees and costs) associated with such claim.
Although the Service Providers establish rules for the operation of Users, the Service Providers do not control or direct the operation of Users on the Service and the Service Providers are not responsible for the information or content that Users publish or share on the Service. The providers of the Service are not responsible for any offensive, inappropriate, obscene, illegal or otherwise objectionable content that may appear on the Service. Service providers are not responsible for the behavior of users of the service online or offline.
The providers of the Service strive to make the Service as functional and secure as possible, but nevertheless the use of the Service is at the User's own risk. The Service is made available to the User as it is at any given time, and the Service Providers cannot guarantee that the Service will always be error-free, functional or available. The providers of the Service are not responsible for the activities of the users of the Service or any other third party, nor for the content or information published by them on the Service. The User of the Service undertakes not to make any claims against the providers of the Service or their personnel related to the claims between the User and another user or a third party related to the Service. Service providers shall not be liable for any consequential damages, including, without limitation, loss of revenue, production, utility, data, or any other contract. In all cases, the total maximum liability of the service providers is limited to a maximum of 100 ETB. These limitations of liability do not apply to the extent that they may be deemed to be in breach of mandatory law, in which case the liability of Service Providers is limited to the minimum permitted by the mandatory law.
14. Change
The Service contains links to third party websites. These third party services and websites are governed by the terms of use and other terms of that third party.
The Terms constitute the entire agreement between you and your Service Provider with respect to your use of the Service and supersede all prior agreements.
If any individual provision of the Terms is held to be invalid, the remaining provisions of the Terms will remain in full force and effect.
You may not assign your rights or obligations under these Terms to any third party without the prior written consent of the Service Providers.
Service Providers have the right to transfer all rights and obligations under these Terms in connection with a merger, acquisition or sale of property, or by operation of law or otherwise.
Nothing in these Terms shall prevent Service Providers from complying with any law or regulation.
Nothing in these Terms is an agreement for the benefit of a third party.
The Service Providers reserve all rights not expressly and in writing granted to the User.
By using the Service, you agree to comply with all applicable laws, regulations and government regulations.
